Who is responsible for your information?
Alex Hurrell trading as Reset My Debt is the data controller for personal information collected through this website and its associated enquiry channels. Our postal address is 44 Mill Street, Kirkcaldy, Fife, KY1 1SD. You can contact us at info@resetmydebt.co.uk or on 0161 524 7162. Reset My Debt is registered with the Information Commissioner’s Office under registration number ZC279119.

1. What information we collect

This notice is intended to meet our transparency duties under the UK GDPR and Data Protection Act 2018. Depending on how you contact us and how far your enquiry progresses, we may collect:

  • your name, mobile number, email address and contact preferences;
  • information about your debts, arrears, creditors, income, household spending, assets, benefits and other financial circumstances;
  • information you provide in forms, calls, SMS or WhatsApp conversations, including documents you choose to send us;
  • campaign or referral information, including the source of your enquiry and the landing-page variant shown to you;
  • technical and security information such as IP address or a hashed form of it, browser/device information, timestamps and interaction events such as page views, form starts and WhatsApp starts; and
  • information received from a marketing or referral partner, or from an existing record, where they are lawfully permitted to share it with us.

If you provide information that is classed as special category data under UK GDPR, we will only use it where it is relevant and where an additional lawful condition permits us to do so.

2. Why we use your information and our lawful bases

We use personal information to respond to your enquiry, understand your circumstances, carry out pre-qualification, communicate with you, keep records, prevent misuse, measure the effectiveness of our campaigns, improve our services and meet legal or regulatory obligations.

  • Steps at your request / contract: where applicable, if processing is necessary to take steps you ask us to take before entering a contract with us, or to perform a contract with us.
  • Consent: where you have actively agreed to a particular use, including electronic marketing where consent is required. You can withdraw consent at any time.
  • Legitimate interests: where necessary for proportionate business purposes such as service administration, security, fraud prevention, quality improvement, attribution and permitted marketing, provided your rights and interests do not override those interests.
  • Legal obligation: where we must keep or disclose information to comply with applicable law, regulation, court orders or lawful requests.

3. Phone, SMS, WhatsApp and marketing

If you ask us to contact you, we may use the channels you select or agree to. Electronic direct marketing is only sent where permitted by the Privacy and Electronic Communications Regulations (PECR) and data protection law. Where consent is required, we rely on consent. Where the law allows another basis, we may rely on legitimate interests after considering your rights.

You can ask us to stop direct marketing at any time. We may keep a limited suppression record so we can honour that request.

4. AI and automated tools

We use software, rules and artificial intelligence to help organise enquiry information, suggest questions, support pre-qualification, route cases and assist staff. These tools do not make final legally binding insolvency or debt-solution decisions for you solely by automated processing. Human review is available where appropriate.

5. Who we share information with

We only share information where there is a legitimate need to do so. Recipients may include:

  • our staff and authorised contractors;
  • CRM, hosting, communications, telephony, SMS, WhatsApp and other technology providers acting for us;
  • professional advisers and debt-solution or insolvency partners where a referral is appropriate and lawful;
  • fraud-prevention, compliance, audit or security providers; and
  • regulators, courts, law-enforcement bodies or other authorities where disclosure is required or permitted by law.

We do not sell personal information as a standalone product. Where we introduce or refer you to a third-party provider, we may share relevant information as described above and only where there is a lawful basis to do so.

Where we make a referral, we will tell you which provider your information is being sent to before or at the time of the referral. We do not give another organisation permission to use your details for its own electronic marketing unless that use is lawful and any consent required by law specifically covers that organisation and the communication method.

6. International transfers

Some technology providers may process information outside the United Kingdom. Where personal data is transferred internationally, we use an approved transfer mechanism where required, such as UK adequacy regulations or appropriate contractual safeguards.

7. How long we keep information

We keep information only for as long as necessary for the purpose for which it was collected and to meet legal, regulatory, complaint-handling, audit and security requirements. Retention therefore varies depending on whether an enquiry is abandoned, referred, progressed or becomes subject to a legal or regulatory record-keeping requirement. Suppression records may be kept for longer where needed to make sure we continue to respect an opt-out. You can ask us for the retention period that applies to your information.

8. Cookies and website measurement

Our current Reset My Debt landing pages do not use non-essential advertising or analytics cookies. We do use server-side campaign and interaction records to understand how people reached the site and whether a page, form or WhatsApp route was used. If we introduce non-essential cookies or similar technologies that require consent, we will provide an appropriate consent mechanism and update this notice.

9. Your UK data protection rights

Depending on the circumstances, you may have the right to:

  • ask for a copy of your personal data;
  • ask us to correct inaccurate or incomplete data;
  • ask us to erase data or restrict how it is used;
  • object to processing based on legitimate interests and object at any time to direct marketing;
  • receive certain information in a portable format;
  • withdraw consent where we rely on consent, without affecting processing already carried out lawfully; and
  • raise a complaint about how your information is handled.

To exercise your rights or make a privacy complaint, email info@resetmydebt.co.uk.

10. Complaints to the ICO

We would like the opportunity to resolve any concern first. You also have the right to complain to the Information Commissioner’s Office (ICO), the UK data protection regulator. Visit ico.org.uk/make-a-complaint/.

11. Security

We use technical and organisational measures designed to protect personal information against accidental loss, misuse, unauthorised access, alteration or disclosure. No internet-based service can be guaranteed to be completely secure.

12. Changes to this policy

We may update this notice when our services, suppliers or legal obligations change. The latest version will always be available from the Privacy Policy links on this website.
